Pretty Pages Terms of Services

Pretty Pages, LLC, otherwise stated here as the Designer and you, otherwise stated here as the Client.

Quotes and Contracts

Quotes provided to prospects will be honored for 30 days. Initial agreement to hire Designer by phone, fax, e-mail or in person will result in the creation of a hard copy contract to be signed by both the Designer and the Client. Contracts that have been written, but not signed by the client will only be accepted within 30 days of the delivery date. A new contract may be drawn up upon request. Upon receipt of the signed contract and the deposit from the Client for services to be rendered by the Designer, work will commence. Both parties will retain a copy of the contract.

Charges & Fees

All new web design projects that are $200 US or less require full payment upon contract signing. Projects where the total cost is between $201 and $1000 US will be split into two payments. An initial 50% deposit will be due at contract signing. The remaining 50% balance will be due upon acceptance of the completed web development project before it is released to the client or published to the internet.

All new web design projects that exceed $1000 US will be split into three payments. An initial deposit of 1/3 of the total project cost will be due at contract signing. A second payment of 1/3 the total project cost will be due upon acceptance of the design. The final balance will be due upon acceptance of the completed web development project before it is released to the client or published to the internet.

Any check payments that do not clear will be charged a $35 fee. Designer retains the right to hold all graphics, and project development with the exception of content and graphics provided by the client, until payment is received for such items.

Web design service fees are separate from domain name registration fees, Internet Service Provider fees, hosting fees or dial up fees. This also includes all peripheral costs related to setting up ecommerce on your websites, which includes but is not limited to the cost of: ecommerce software, after-market modifications to the ecommerce software, SSL certificate, and payment provider fees (gateway and merchant account setup fees and ongoing fees). All of these costs are the responsibility of the Client. The Designer is not responsible or liable for any damages that may occur to the Client for use of any outside services.

Designer also reserves the right to request advances against expenses or to bill the Client for these items. Furthermore, Client agrees to reimburse the Designer for all expenses of production as well as related expenses including but not limited to illustration, photography, travel, messengers, telephone, and unreturned electronic
storage media. If any advances against expenses apply, it will be outlined in the contract.

Payments & Refunds

Pretty Pages accepts checks or money orders made payable to Pretty Pages, LLC in US dollars. Payments can also be made via MasterCard/Visa/Discover/American Express through Pay Pal.

The Designer will do it's best to provide the Client with a 100% satisfactory product. If at any time the Client becomes dissatisfied with the product, prior to final upload, the Client will request, in writing, that the Designer discontinue work on the product and a refund will be sent to the Client. This will indicate the termination of the contract. Upon termination the Client will have no rights to ownership of any products provided by the Designer that have been previewed. To determine the amount of refund due, please follow the refund policy outlined below:

  1. A full refund of the total deposit paid will be issued for projects that have been booked, but cancelled prior to the start date.
  2. A cancellation fee of 30% (thirty percent) of the total deposit paid will be retained for projects that have been started and are in the design process.
  3. A design fee of $150 (two-hundred and fifty dollars) will be retained on projects where the design portion of the development has been completed, and the client has accepted the design, but whereas the development process of the project has not begun.
  4. Projects that are in the development process at the time the request for termination is received will be billed at the hourly rate of $60 per hour. Should the amount of time put into your project be greater than the deposit you have paid to Pretty Pages, you will be billed the difference. Upon payment of these fees, the work completed up to the time of termination will be released to the client.
  5. Once the final product is uploaded onto the Client's server, no refunds will be issued.

Refunds will be processed within 30 business days of request by the client, if there is a refund amount due based on the terms above.


Billing

Designer shall invoice Client as fees are due and Client shall pay within 30 days of receipt of each invoice. Overdue payments shall be subject to interest charges of 13% percent monthly.

Client Responsibilities and Confidentiality

Any and all assets that Client is to supply for the Web Site shall be delivered to the Designer by the date specified in the contract, in electronic format (delivered on removable storage media or transmitted via the Internet), and such supplied assets shall be in final form and ready for Web Site use. Client shall proofread and edit such assets prior to delivery to Designer, and any additional work due to corrections
of such assets, file conversions, or scanning of text or images shall be billed additionally to the fee specified in the contract. The Designer agrees that any asset supplied by Client, whether for the Web Site or in relation to the business purposes for its development, shall be treated as confidential and neither disclosed to third parties
nor used in any way other than for the development of the Web Site. At the completion of work, the Designer shall return to Client the assets supplied by Client.

Authorship Credit

Authorship credit in the name of the Designer shall appear on the Web Site in the footer along with the Designer’s e-mail address and a link to the Designer's Web Site. If Client alters the Web Site design, the Designer shall have the right to have Designer’s name removed from the Web Site.

Grants of Rights & Releases

The Client warrants that it has the right to enter into this Agreement and that Client owns or has obtained appropriate Web Site usage rights for any assets supplied by the Client to the Designer. The Client shall indemnify and hold harmless the Designer and its subcontractors against any and all claims, lawsuits, costs, and expenses, including reasonable attorney’s fees, arising in connection with the Web Site. This indemnification shall extend to assets obtained by the Designer on the Client’s behalf if the Designer has secured either exclusive or nonexclusive world Web Site usage rights.

Upon receipt of full payment, Designer shall grant to the Client exclusive world Web Site usage rights for the business, nonprofit organization, project, product, or publication. The Client shall be the owner of the Web Site but shall have the right to use the Web Site design for this particular Web Site only. In addition, the Client shall have the right to use assets supplied by the Designer only for the Web Site. The html files, images files, animations, Java scripts, CGI programs, and related assets supplied by the Designer may not be used by the Client apart from their use on the Web Site. The Designer retains the right to make portfolio use of the Web Site or parts thereof after the Web Site has been placed on Client’s Web server.

Warranty and Liability

UNDER NO CIRCUMSTANCES, SHALL PRETTY PAGES, LLC, OR ANY OWNERS, EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, VENDORS, ASSOCIATES, AFFLIATES, FAMILY MEMBERS, OR SUPPLIERS BE LIABLE FOR ANY DIRECT OR INDIRECT LOSSES OR DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF, INABILITY TO USE, INFORMATION COLLECTED FROM, OR PRODUCTS AND SERVICES PROVIDED BY OR ON BEHALF OF A WEBSITE CREATED OR MAINTAINED BY PRETTY PAGES, LLC.

WHILE IT IS THE SOLE PURPOSE OF PRETTY PAGES, LLC TO PROVIDE A SATISFACTORY, FUNCTIONAL WEBSITE AS REQUESTED BY THE CLIENT, PRETTY PAGES, LLC MAKES NO CLAIMS AS TO THE SUCCESS, USABILITY, SEARCH ENGINE RANKINGS, USE OR INTERPRETATION OF INFORMATION, SUITABILITY, RELIABILITY, TIMELINESS, ACCURACY OF THE INFORMATION, PRODUCTS, AND SERVICES CONTAINED ON A WEBSITE CREATED OR MAINTAINED BY PRETTY PAGES, LLC.

YOU AGREE THAT OUR ENTIRE LIABILITY, AND YOUR EXCLUSIVE REMEDY WITH RESPECT TO ANY PRETTY PAGES, LLC SERVICE(S) PROVIDED UNDER THIS AGREEMENT AND/OR FOR ANY BREACH OF THIS AGREEMENT IS SOLELY LIMITED TO THE AMOUNT YOU PAID FOR SUCH SERVICE(S) DURING THE TERM OF THIS AGREEMENT.

PRETTY PAGES, LLC ASSUMES NO RISK OR RESPONSIBILITY FOR USE OF ANY OF THE CONTENT PROVIDED ON SITES CREATED OR MAINTAINED BY PRETTY PAGES, LLC

PRETTY PAGES, LLC WILL NOT AND SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES OR INJURY, INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM:

FURTHER, THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, INTERPRETATION, OMISSION, INACCURACY, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF A WEBSITE CREATED OR MAINTAINED AND/OR BY A SITE LINKED TO OR FROM A SITE CREATED OR MAINTAINED PRETTY PAGES, LLC, WHETHER FOR BREACH OF CONTRACT, TORTUOUS BEHAVIOR (INCLUDING STRICT LIABILITY), NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION. PRETTY PAGES, LLC IS NOT LIABLE FOR DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES.

Privacy Policy

Pretty Pages, LLC is committed to honoring the privacy of our clients and visitors requesting information. Only information that the Client specifies, will be used on the Client's web site. Information that is collected that will not be used on the Client's web site is held in strict confidence. This information will not be released or sold to any third party for any reason unless permission is granted from the client. The release of certain information, as required to submit the client's site to search engines and directories, will be done so only after permission is granted from the Client.
